What are the requirements to buy a property in Spain?

One of the most common mistakes when buying a home in Spain is thinking that the process begins once you find the right property. In reality, there are a number of requirements, documents and procedures that you should be familiar with before taking the next step. Having all this information prepared from the beginning helps avoid delays and makes the buying process much easier.

For this reason, at Brightbay we support those looking for a home on the Costa Tropical, ensuring that the entire process is clear from the very beginning.

Buying a property in Spain

Buying a property in Spain continues to be one of the most attractive options, both for those looking for a primary residence and for those wishing to purchase a second home or make a long-term investment. The country’s appeal, the variety of available locations and the wide range of properties mean that thousands of people, both Spanish and international buyers, decide to take this step every year.

In recent years, the real estate market has undergone significant changes. In many areas, demand remains high, especially in coastal locations and municipalities with a high quality of life. This has resulted in a more limited supply of available properties and shorter times to find certain homes. As a result, it has become increasingly common for buyers to spend time comparing different options before making a decision.

In addition to the price, buyers today also value other aspects such as the location, energy efficiency, construction quality, nearby amenities and the opportunities offered by the surrounding area. All of this means that buying a home is a decision that requires careful planning and a good understanding of the property market, as knowing the current situation helps buyers choose a property that truly suits their needs and objectives.

Requirements to buy a property in Spain

Although every purchase has its own particular circumstances, there are a number of requirements and documents that you should be aware of before buying a property in Spain.

Have a valid identification document

The first requirement for buying a home is being able to prove your identity with a valid official document. Spanish citizens must provide their National Identity Document (DNI), while citizens of other countries may identify themselves using their passport or national identity card.

If the buyer is a foreign national, it will also be necessary to obtain a Foreigner Identification Number (NIE). This document is mandatory for carrying out any financial transaction in Spain, including purchasing a property, paying taxes or arranging utility services. In many cases, it is also advisable to have a Spanish bank account to facilitate all payments related to the purchase.

Demonstrate financial capacity to purchase the property

Before buying a property, it is important to have the financial resources needed to complete the purchase. This means considering not only the property’s purchase price, but also the taxes and expenses associated with the transaction, such as notary fees, registration with the Land Registry and, where applicable, costs related to financing.

If you are applying for a mortgage, you will also need to have sufficient funds to cover the deposit and any amounts not financed by the lender. When the purchase is financed through a mortgage loan, the bank will need to assess the buyer’s financial situation before granting the loan.

To do so, it will usually request documents such as recent payslips, the employment contract, the latest income tax return, recent bank statements or an employment history report. Self-employed buyers will also need to provide tax documentation relating to their business activity.

Each bank may request additional information, but the objective is always to verify that the buyer has sufficient financial capacity to repay the loan.

Check that all the property documentation is in order

Before signing any contract, it is advisable to review the property’s documentation to ensure that everything is legally in order.

Among the most important documents are the Land Registry extract, which confirms ownership of the property and checks whether there are any outstanding charges; the cadastral reference; the Energy Performance Certificate; the latest Property Tax (IBI) receipt; and, where applicable, a certificate confirming that all community fees have been paid.

If the property is newly built, it is also advisable to verify that it has the first occupancy licence and all other documentation required under current regulations.

Sign the necessary contracts to complete the purchase

Once all the documentation has been reviewed, the next step is to formalise the transaction. In many cases, the buyer and seller first sign a deposit agreement, through which both parties commit to completing the purchase under the agreed terms.

The transaction is then formalised by signing the public deed before a notary. During this process, the identities of both parties are verified, the documentation is reviewed and the document confirming the transfer of ownership is signed.

Fulfil the tax obligations after the purchase

Once the deed has been signed, there are still several administrative procedures that must be completed in order to finalise the purchase correctly. These include paying the relevant taxes according to the type of property purchased, as well as registering the property with the Land Registry.

It is also advisable to transfer the utility accounts into the new owner’s name and keep all documentation relating to the purchase. Completing these procedures ensures that the acquisition is legally completed and that the new owner can enjoy the property with full legal security.
